Gift from George, LLC (“GFG”) is pleased to introduce the GFG Promotional Games (each, a “Game” and collectively, the “Games”), which are designed to stimulate charitable giving through the GFG website, www.giftfromgeorge.com, (“Website”), its mobile application, and other services (collectively, the “GFG Services”). Each Game begins at a designated time and date and ends according to a specified criteria on or before a designated time and date (“Game Promotion Period”), as set forth on the Game entry page. All games will be based off of Eastern Standard Time (EST). GFG’s computer shall be the official clock for purposes of the Games.
As a condition of participating in a Game, you agree to be fully and unconditionally bound by these Official Rules and the decisions of GFG, whose decisions shall be final and binding in all respects, and to waive any right to claim ambiguity in the Game, these Official Rules, Game materials, or information contained on GFG’s website, available at www.giftfromgeorge.com. The Games are subject to applicable federal, state, and local laws and regulations and are VOID WHERE PROHIBITED OR RESTRICTED BY LAW. Winning and receiving a Prize, as defined below, is contingent upon fulfilling all requirements set forth herein.
As condition of participating in a Game, you acknowledge and agree that Facebook Inc., Instagram, LLC, Twitter Inc. and their owners, directors, officers, employees, contractors, agents, representatives, parents, subsidiaries, attorneys, insurers, and associated corporations and entities (collectively, the “Facebook/Instagram/Twitter Group”) are not sponsors of the Games nor do they endorse or administer the Games, nor are they in any way associated with the Games. All questions regarding the Games must be directed to GFG, not the Facebook/Instagram/Twitter Group. You also agree that as a condition of participating in a Game, you shall release the Facebook/Instagram/Twitter Group from any and all liability arising out of or relating to your entry, creation of an entry or submission of an entry, participation in a Game, acceptance, use, or misuse of a Prize, or the broadcast, exploitation, or use of an entry.
The Games are open only to: (i) natural persons and (ii) charitable organizations, each of whom are subject to the following additional eligibility requirements:
To be eligible to participate in a Game, you must, at the time of participation: (i) be at least eighteen (18) years of age or the age of majority in your jurisdiction of residence, whichever is greater; (ii) be a permanent legal resident of the United States of America who is physically located and residing therein (excluding _____________________); (iii) have an active GFG Account (“Account”); and (iv) at all times abide by these Official Rules. Employees, officers, directors, members, managers, investors, agents, and representatives of GFG and any of its or their parent companies, subsidiaries, affiliates, licensees, licensors, contractors, third party Game sponsors, prize providers, content providers, vendors, component suppliers (both hardware and software), third parties who provide products or services purchased from or distributed by GFG and each of their respective immediate family (defined as parents, spouse, partner, and children) and any person residing in the same household are NOT eligible to participate in the Games or win Prizes. If any such person is deemed to be a Game winner, any Prizes won will be forfeited and may be awarded to an alternate potential winner at GFG's sole discretion and in accordance with these Official Rules.
To be eligible to participate in a Game, the charitable organization must, at the time of participation: (i) be a qualified 501(c)3 organization in good standing with the United States Internal Revenue Service and all regulatory agencies with jurisdiction over the organization’s operations; (ii) have an active charitable organization Account; (iii) satisfy the minimum donation threshold requirements (“Threshold Requirements”); and (iv) at all times abide by these Official Rules. The Games offered by GFG will be structured based on a tier system that dictates the prize pool and entry requirements. To review the available Game tiers and full details regarding the entry requirements, visit www.giftfromgeorge.com/game-faqs.
To determine each charitable organization’s tier eligibility, GFG uses the total overall donations an eligible charitable organization receives through the GFG Services (“Total Overall Donations”) and the total donations available (“Total Available Donations”) to satisfy the applicable Threshold Requirement, which is calculated as ten percent (10%) of the respective tier level. Total Available Donations are calculated based on a charitable organization’s Total Overall Donations less any previous Threshold Requirements deducted to participate in a Game. For example, if a charitable organization has received $2,500 in Total Overall Donations and has participated in two (2) $10,000 tier level Games, the charitable organization’s Total Available Donations for purposes of satisfying the Threshold Requirement would be $500. The charitable organization would therefore require an additional $500 in donations to meet the Threshold Requirement necessary to participate in another $10,000 tier level Game.
Once a charitable organization has qualified for and opted to enter a Game, the Threshold Requirement will be deducted from the charitable organization’s Total Available Donation balance and earmarked for delivery to the charitable organization at a later date, as determined by GFG at its sole discretion. A Game will only begin when three (3) charitable organizations have qualified for and opted to enter a Game of the same tier level and Gift from George has deemed them suitable to participate in a single game. The Game Promotion Period will begin when Gift from George has qualified three (3) suitable charities and will announce the new game. Details regarding the Game Promotion Period will be accessible at the Game entry page portion of the Website. Eligible charitable organizations may only participate in one (1) Game at a time.
In order to advance to a higher tier level, an eligible charitable organization must: (i) accrue Total Available Donations equal to or greater than the respective tier’s Threshold Requirement within a specified amount of time and (ii) demonstrate consistent support and success at the $10,000 tier level, as determined by GFG at its sole discretion. For example, in order to be eligible to qualify for the $25,000 tier level, a charitable organization must: (i) accrue at least $2,500 in Total Available Donations within three (3) months of time and (ii) place first (1st) in at least five (5) Games and receive special invitation from the GFG Team, as calculated in Section 4.1. GFG also reserves the right to invite eligible charitable organizations to participate in a higher tier level at its sole discretion.
After a Game tier has been filled by three (3) eligible charitable organizations, the Game, along with details regarding the Game Promotion Period, will be accessible at the Game entry page portion of the Website. Once the Game Promotion Period begins, eligible users of the GFG Services will have the opportunity to obtain an entry into a Game and cast a vote for competing charitable organizations of their choice. To enter a Game and cast a vote during a Game Promotion Period, visit the Website, available at www.giftfromgeorge.com, and log-in to your Account. After logging-in to your account, find the game or charity you wish to participate in, vote for a charity, choose numbers, and confirm your number selection and your charity of choice.

To obtain an entry into a Game via the monetary method of entry, purchase GFG Bucks after logging-in to your account. After purchasing GFG Bucks, follow the onscreen instructions to redeem one (1) or more GFG Bucks for an entry into a Game.

You may obtain GFG Bucks, which can be used to obtain an entry into a Game, without cost via the friend referral method of entry. To obtain GFG Bucks via the friend referral method of entry, Users may visit the website, login to their Account, visit their profile page and find their unique friend referral code. A User’s referral must then create an account, and use the friend referral code before entering into their first game. Once the referral code has been entered, both the User and the referral will be awarded one GFG buck valid towards any normal game. Referrals are required to enter their payment information to be fully registered in order to be eligible for their GFG Buck. Abuse of this system may result in the suspension or immediate termination of the account(s) and the revocation of any game entries current or past. For each monetary or non-monetary entry you receive, you will be required to cast one (1) vote for a competing charity at which point will receive one (1) set of number choices for a chance to win a Prize. You are required to choose five (5) main number selections (1-59), one (1) special ball (1-30), and up to five (0-5) bonus ball selections (1-59) depending on the game tier size, which provide “bonus chances” to match main number selections only. The same numbers cannot be chosen more than once per entry.
Using an automated system to enter a Game or attempting to subvert the entry process is prohibited and may result in disqualification. In the event of a dispute as to any entry, the authorized account holder of the email address registered with the Account used to enter the Game will be deemed to be the entrant. The “authorized account holder” is the natural person assigned the email address by the internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address. GFG reserves the right to require entrants to show proof of being the authorized account holder.
GFG is not responsible for incorrect or inaccurate transcription of entries, computer, online or human error, technical malfunctions, any omission, interruption, defect, or any other error, including, but not limited to, lost, late, incomplete, invalid, unintelligible or misdirected entries, all of which may constitute grounds for disqualification in GFG’s sole discretion. If a problem occurs in the entry process, you are solely responsible for verifying that the entry process has been validly completed. You are responsible for all online charges incurred with any Internet service provider and/or wireless carrier.
Following the conclusion of a Game’s applicable Game Promotion Period, GFG or its designated representative will count the total votes received by each of the competing charitable organizations, which will be displayed on the Game entry page. The competing charitable organizations will be ranked according to the number of votes they received.
Following the conclusion of a Game’s applicable Game Promotion Period, GFG or its designated representative will conduct a drawing using an advanced proprietary random number generator developed by third-party vendors to select five (5) winning main number selections (1-59), one (1) special ball selection (1-30), and up to five (0-5) bonus ball selections (1-59) depending on the game tier size, which provide “bonus chances” to match main number selections only. Potential winners will be determined based on the natural persons who match the most numbers, including the special number selection, according to the following hierarchy:
If more than one (1) natural person matches the same number of ball selections qualifying for a Prize, the respective Prize for which the tie exists will be split evenly between the potential winners of that Prize, subject to verification of eligibility and compliance with these Official Rules. If no natural person(s) match any numbers, then redrawing will occur within one (1) day. If an insufficient number of natural persons do not match numbers to fill each Prize category, then the person(s) with the next greatest matching numbers will be moved up to the empty prize category and this will continue until all prize categories are filled. This process applies for all prize categories. For the avoidance of doubt, the method of entry will not be taken into account in the winner selection process.
ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION OF ELIGIBILITY AND COMPLIANCE WITH THESE OFFICIAL RULES. GFG’S DECISIONS AS TO THE ADMINISTRATION AND OPERATION OF THE GAMES, ANY CHANGES TO THESE OFFICIAL RULES, AND THE SELECTION OF POTENTIAL WINNERS IS FINAL AND BINDING ON EACH PARTICIPANT IN ALL MATTERS RELATED TO THE GAMES.
The total ARV of all prizes (each, a “Prize” and collectively, the “Prizes”) in the GFG prize pool (“Total Prize Pool”) is 90%. In a $10,000 tier game 90% is $9,000.00. Prizes will be awarded from the Total Prize Pool as follows:
Each charitable organization will receive a Prize from the Charitable Organization Prize Pool, which consists of 25% of the Total Prize Pool, in proportion to the number of votes received during the Game. The formula is as follows:
Game Tier Size X 25% X (Received Votes/Total Votes)
At a minimum, charitable organizations will receive one percent (1%) of the Total Prize Pool. For example, if a charitable organization participates in a $10,000 tier level Game, it is guaranteed to receive one hundred dollars ($100) even if it receives less than one percent (1%) of the votes for the Game. In the event that this occurs, the other two (2) charities will receive prizes using this formula:
((Game Tier Size X 25%) - $100)) X (Received Votes/(Total Votes – 3rd Place Total Votes))
Charitable organizations will also receive a bonus (“GFG Bonus”), which consists of 15% of the Total Prize Pool, based on their rank in total number of votes received. The GFG Bonus will be awarded according to the following schedule:
Winning persons, based on their rank pursuant to Section 4.2, will receive a portion of the Natural Person Prize Pool, which consists of 50% of the Total Prize Pool, according to the following schedule:
If more than one (1) natural person matches the same number of ball selections qualifying for a Prize, the respective Prize for which the tie exists will be split evenly between the potential winners of that Prize, subject to verification of eligibility and compliance with these Official Rules. If no natural person(s) match any numbers, then redrawing will occur within one (1) day. If an insufficient number of natural persons do not match numbers to fill each Prize category, then the person(s) with the next greatest matching numbers will be moved up to the empty prize category and this will continue until all prize categories are filled. This process applies for all prize categories. For the avoidance of doubt, the method of entry will not be taken into account in the winner selection process.
Within thirty (30) days after the Game Promotion Period ends, the charitable organizations’ accounts will be credited for their respective Prizes. Potential winners who are natural persons will be contacted within three to seven (3-7) days via a verification email using the email address that corresponds to their Account. The potential winners will be awarded the applicable Prize subject to verification of eligibility and compliance with all terms and conditions of these Official Rules. If a potential winner fails to respond to the verification email within forty-eight (48) hours of notification or the email notification is returned as undeliverable after two (2) attempts, the potential winner may be disqualified in GFG’s sole discretion.
Natural persons who are potential winners may be required to provide their Social Security number or tax ID for tax reporting purposes if GFG is required to file an IRS Form 1099 with the Internal Revenue Service for the fair market value of a Prize awarded and accepted. Except where prohibited, potential winners also may be required to sign and return to GFG, within five (5) business days from the date when GFG’s initial verification email was sent, a declaration of eligibility and liability/publicity release (“Declaration”) via email to the address specified in the Declaration in order to claim his or her Prize. If a potential winner fails to complete, sign and return the applicable Declaration within the required time period, or if the Declaration is returned as undeliverable or incomplete, the potential winner may be disqualified in GFG’s sole discretion.
In the event a charitable organization or natural person is disqualified for any reason, or if a Prize is unclaimed, the Prize will be forfeit. GFG, at its sole discretion, may award the forfeit Prize to an alternate potential winner. If a charitable organization is disqualified, GFG may award the forfeit Prize to the remaining charitable organizations in a manner it deems reasonable at its sole discretion. If a natural person is disqualified, the alternate potential winner will be determined to be: (i) the eligible potential winner(s) who tied with the disqualified potential winner or (ii) the potential winner(s) who match the most numbers after the disqualified potential winner. Alternate potential winner(s) will be contacted within forty-eight (48) hours using the email address that corresponds to the natural person’s Account. If the alternate potential winner(s) fails to respond to the verification email within forty-eight (48) hours of notification or the email notification is returned as undeliverable after two (2) attempts, the alternate potential winner may be disqualified in GFG’s sole discretion. GFG retains the right to repeat this process until an alternate potential winner complies with the verification of eligibility requirements.
ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR. SPONSOR’S DECISIONS AS TO THE ADMINISTRATION AND OPERATION OF THE SWEEPSTAKES, ANY CHANGES TO THESE OFFICIAL RULES, AND THE SELECTION OF POTENTIAL WINNERS IS FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES.
There are no limits on prizes per charitable organization or natural person per calendar month per calendar year. No transfer or substitution for a Prize will be made, except that GFG, at its sole discretion, may substitute a Prize of equal or greater value for any reason. Winners will have the option the receive Prizes as GFG bucks, check in the mail, pre-paid gift card (if available), direct deposit, PayPal, or WePay. The Prizes will be sent to the winning charitable organizations and natural persons within thirty (30) days following the Game Promotion Period subject to compliance with these Official Rules.
All expenses not specified above, including any federal, state, or local taxes are the sole responsibility of each Prize winner. Any required tax reporting forms will be furnished to the appropriate authorities. In the event that the Game is cancelled or postponed for any reason whatsoever, the ARV of the Prizes will be awarded to the extent required by law. No more than the stated number of Prizes will be awarded. There is no geographic allocation of any Prizes.
ALL PRIZES ARE AWARDED AS IS AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. By entering, each participant agrees to: (i) comply with and be bound by these Official Rules and the decisions of GFG as they may be amended from time to time and (ii) release, indemnify, defend, and hold harmless GFG, its respective parents, subsidiaries, affiliates, licensees, licensors, contractors, third party Game sponsors, prize providers, content providers, vendors, component suppliers (both hardware and software), third parties who provide products or services purchased or distributed by GFG, the Facebook/Instagram/Twitter Group, and each of its and their respective past and present employees, officers, directors, members, managers, investors, agents, and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability resulting or arising from the Game (including reasonable attorneys’ fees), including, but not limited to, negligence and damages of any kind to persons and property, invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright, or other intellectual property rights, property damage, or death or personal injury arising out of or relating to participation in a Game, creation or submission of an entry, acceptance, use, or misuse of a Prize, or the broadcast, exploitation, or use of an entry. Released Parties are also not responsible for any typographical or other error contained in the Official Rules or Sweepstakes-related materials.
Except where prohibited by law, by participating in a Game or accepting a Prize, participating charitable organizations and natural persons grant GFG and its designees the right to use their name, photograph, likeness, comments, biographical information, voice, address, and other identifying information for advertising and promotional purposes for this Game and similar promotions, worldwide, and in perpetuity, in any and all forms of media, now known or hereafter devised without additional compensation, review or approval rights, notification or permission.
PARTICIPANTS FURTHER ACKNOWLEDGE THAT THEIR INFORMATION, INCLUDING PERSONAL IDENTIFYING INFORMATION (WHERE APPLICABLE), MAY BE DISCLOSED TO THIRD PARTIES INCLUDING, WITHOUT LIMITATION, PLACING THEIR NAME ON A WINNERS’ LIST.
By participating in a Game, charitable organizations and natural persons acknowledge and agree that they are providing their information to GFG, not the Facebook/Instagram/Twitter Group. Charitable organizations and natural persons further acknowledge and agree that they have read and consent to GFG’s use of their personal information (where applicable) as described in GFG’s privacy policy, available at www.giftfromgeorge.com/privacy-policy.
The Game is subject to all applicable federal, state, and local laws and regulations. Winning a Prize is contingent upon accepting and fulfilling all requirements of these Official Rules. GFG reserves the right, without liability, to disqualify any participant or cancel, suspend, modify and/or terminate the Game, or any part of it, for any reason, including, but not limited to, insufficient entries, any printing, seeding, typographical, technical errors, human or otherwise, suspected or actual evidence of electronic or non-electronic tampering with any portion of the Game, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Game or any other factor beyond GFG’s reasonable control, as determined by GFG in its sole discretion.
In such event, GFG reserves the right to award the Prizes to the extent required by law for eligible entries submitted up to the time of the impairment (and/or thereafter), or in such other manner as deemed fair and appropriate by GFG in its sole discretion. GFG reserves the right to disqualify any individual it finds to be tampering or interfering with the operation of the Game, acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner and void all such individual’s entries.
ANY ATTEMPT BY ANY PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE GAME MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, GFG RESERVES THE RIGHT TO SEEK CIVIL AND/OR CRIMINAL PROSECUTION AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. GFG's failure to enforce any term of these Official Rules will not constitute a waiver of that provision. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof.
To the maximum extent permitted by law, the Released Parties are not responsible for: (i) any incorrect or inaccurate information, whether caused by participants, technical errors, or by any of the equipment or programming associated with or utilized in the Game; (ii) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections of the equipment or software associated with or utilized in the Game; (iii) unauthorized human and/or mechanical intervention in any part of the entry process or the Game; (iv) technical or human error which may occur in the administration of the Game or the processing of entries; or (v) any injury or damage to persons or property including, without limitation, death, bodily injury and emotional distress, which may be caused, directly or indirectly, in whole or in part, from a charitable organization’s or natural person’s participation in the Game or receipt, use or misuse of any Prize. If for any reason a participant’s entry is confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted, participant’s sole remedy is to submit another entry during the Game Promotion Period through the methods set forth in these Official Rules.
Any and all disputes, claims, and causes of action arising out of or connected with a Game or any Prize awarded shall be resolved in accordance with the Binding Arbitration and Class Action Waiver found in GFG’s Terms and Conditions of Use, available at www.giftfromgeorge.com/terms-&-conditions.
Unless otherwise specified in these Official Rules, words importing the singular include the plural and vice versa and words importing gender include all genders. All dollar amounts referred to in these Official Rules are in lawful money of the United States of America. GFG is not responsible for any damages caused by delay or failure to perform undertakings pursuant to these Official Rules when the delay or failure is due to weather, event cancellations, fires, strikes, floods, acts of God or the state’s enemies, lawful acts of public authorities, delays or defaults caused by common carriers, or other events that cannot reasonably be foreseen or provided against.
